10 influential authors who came to the US as immigrants

Though not born on American soil, these 10 authors all became United States citizens. Some were pushed here by political forces, some came for job opportunities, but each brought a new thread to the American tapestry. Today, as the US Congress struggles with the issue of immigration reform, seems an opportune moment to remember the contributions that this talented group has made to American literature and culture.

1. Khaled Hosseini

Khaled Hosseini was born in Afghanistan, moved to Paris, and became a US citizen following the Russian invasion of his native country in 1980. His 2003 novel "The Kite Runner" was on The New York Times bestseller list for over a year. Hosseini's work tends to focus on family, violence, and the greater forces that shape personal lives. "The Kite Runner," about the life of a young Afghani refugee who must confront his traumatic childhood as an adult, was adapted into a movie in 2007. The movie rights have been bought to his second novel, "A Thousand Splendid Suns."

His third book, "And the Mountains Echoed" is due out in May of this year.

(AP) ? Big business and labor have resolved a dispute over a low-skilled worker program that threatened to hold up agreement on a sweeping immigration bill, according to a person familiar with the negotiations.

The deal was struck in a phone call late Friday night with AFL-CIO President Richard Trumka, U.S. Chamber of Commerce head Tom Donohue, and Democratic Sen. Chuck Schumer of New York, who's been mediating the dispute.

The person, who spoke on condition of anonymity ahead of a formal announcement, said the deal resolves disagreements over wages for the new workers and which industries would be included. That had led talks to break down a week ago.

The deal must still be signed off on by the seven other senators working with Schumer to negotiate a bipartisan immigration bill ? but that's expected to happen. The agreement between business and labor removes the biggest hurdle to completion of the immigration bill to secure the border, crack down on employers, improve legal immigration and create a pathway to citizenship for 11 million illegal immigrants already here.

The bipartisan senate group is expected to introduce the bill the week of April 8 after Congress returns from a two-week recess.

The AFL-CIO and the Chamber had been fighting over wages for tens of thousands of low-skilled workers who would be brought in under the new program to fill jobs in construction, hotels and resorts, nursing homes and restaurants, and other industries.

On Friday, officials from both sides said there was basic agreement on the wage issue, and Schumer said a final deal on the worker dispute was very close.

"We're feeling very optimistic on immigration: Aspiring Americans will receive the road map to citizenship they deserve and we can modernize 'future flow' without reducing wages for any local workers, regardless of what papers they carry," AFL-CIO spokesman Jeff Hauser said in a statement earlier this week. "Future flow" refers to future arrivals of legal immigrants.

Under the emerging agreement between business and labor, a new "W'' visa program would bring tens of thousands of lower-skilled workers a year to the country. The program would be capped at 200,000 a year, but the number of visas would fluctuate, depending on unemployment rates, job openings, employer demand and data collected by a new federal bureau pushed by the labor movement as an objective monitor of the market.

The workers would be able to change jobs and could seek permanent residency. Under current temporary worker programs, personnel can't move from employer to employer and have no path to permanent U.S. residence and citizenship. And currently there's no good way for employers to bring many low-skilled workers to the U.S. An existing visa program for low-wage nonagricultural workers is capped at 66,000 per year and is supposed to apply only to seasonal or temporary jobs.

The Chamber of Commerce said workers would earn actual wages paid to American workers or the prevailing wages for the industry they're working in, whichever is higher. The Labor Department determines prevailing wage based on customary rates in specific localities, so that it varies from city to city.

The low-skilled worker issue had loomed for weeks as perhaps the toughest matter to settle in monthslong closed-door talks on immigration among the senators, including Republicans John McCain of Arizona and Marco Rubio of Florida. The issue helped sink the last major attempt at immigration overhaul in 2007, when the legislation foundered on the Senate floor after an amendment was added to end a temporary worker program after five years, threatening a key priority of the business community.

The amendment passed by just one vote, 49-48. President Barack Obama, a senator at the time, joined in the narrow majority voting to end the program after five years.

SAfrican official: Mandela better from pneumonia

JOHANNESBURG (AP) ? A South African official says Nelson Mandela is breathing "without difficulty" after having a procedure to clear fluid in his lung area that was caused by pneumonia.

South African presidential spokesman Mac Maharaj said Saturday that 94-year-old Mandela that the fluid had been "tapped," allowing the former president to breathe more easily.

Maharaj described the fluid problem as a "pleural effusion."

He said Mandela is suffering from pneumonia, using a different term for his ailment. Officials have previously said Mandela, who was taken to a hospital on Wednesday night, has a recurring lung infection.

Dorf on Law: Vegan Wine (Cross-Posting with the Society of Wine ...

The leaders of the Society of Wine & Jurisprudence at Cornell Law School--yes, that is a real organization--asked me to write something for their blog.? I agreed to write about vegan wine.? Hence the following post appeared there?a couple of days ago and I'm cross-posting here today.

As an ethical vegan, I am often asked strange questions.? ?Would you eat roadkill??? ?If you were in a lifeboat with a cow, a chicken and Dick Cheney, which one would you eat first??? Etc.

These questions are not silly merely because they are hypothetical.? Lord knows that as a law professor, much of what I do is ask my students hypothetical questions, often quite bizarre ones.? I do so to test the principle that a court or a student has espoused (e.g., ?the federal government lacks the power to regulate inactivity?) by exploring circumstances in which the intuition underlying the principle appears to break down (e.g., ?can federal labor law forbid secondary boycotts??).

I do not doubt that many of the strange questions I am asked have the same purpose.? My interlocutor hasn?t met a lot of vegans and is making a genuine effort to understand the ethical principle that motivates me.? I am always happy to answer questions asked in this spirit, even if I have answered them many times before.

Some of the questions I am asked appear to have a different purpose, however.? ?Are your shoes leather?? is often a question designed as a trap.? If I say yes, the questioner can conclude that I am a hypocrite who can be safely disregarded.? If I say no, my questioner will conclude that living as a vegan is so demanding as to be impossible for anyone but a single-minded zealot.? (In fact, my belts, shoes, sneakers, boots, and all of my other clothes are made from man-made materials, and were quite easy to obtain.)? Nonetheless, I try to answer every question as though it were asked in good faith, in part because you never know when it really was.

For a comprehensive effort to answer the sorts of questions people frequently ask vegans, I highly recommend Professor Colb?s forthcoming book, Mind if I Order the Cheeseburger?.?? But while you?re awaiting that book?s appearance in stores and online (in May), I want to discuss one of the few circumstances in which I find being vegan a bit of a challenge: purchasing vegan wine, beer and spirits.
But wait, you say.? Aren?t all wines, beers and spirits made from fruits and vegetables?? The truth is a bit more complicated.? Although wine, beer and spirits consist almost entirely of liquids derived from non-animal sources, the process by which the raw materials are converted into these liquids frequently uses animal products, most commonly to filter out impurities.? As one helpful website explains: ?The most common animal ingredients used in wine making are isinglass (a very pure form of gelatine from sturgeon fish bladders), gelatine (extract from boiled cow?s or pig?s hooves and sinews), egg whites (or albumin) and caseins (a protein from milk).?

Now if one were a vegan purely for health reasons, one would not have reason to worry much about the use of animal products for filtering.? Occasionally, the filtering would leave a trace of some animal product, but not in sufficient quantities to make a noticeable health difference.? However, as an ethical vegan (who sees health as a beneficial side effect of veganism), my chief concern is to avoid consuming products that are made using processes that deliberately harm or kill sentient beings.? It?s not enough to avoid eating the animals.? I don?t want to eat (or otherwise contribute to the economic demand for) products that have been produced by harming or killing animals.

Many wineries, breweries and distilleries produce excellent wines, beers and spirits (respectively) using non-animal filtering agents.? The tricky part is that labels typically do not say whether a particular wine, beer or spirit has been produced with or without filtration through animal products.

Luckily, we live in an age of technological marvels.? The website Barnivore provides a great deal of information on numerous wines, beers and spirits.? And there?s an iPhone app called VeganXpress, which pulls in the latest info from Barnivore, in addition to listing information about food available in stores, movie theaters and chain restaurants.? (Did you know that the corn on the cob and the green beans at KFC are vegan?? I?m not recommending that anyone go there.? I?m just saying that if I were to find myself in a lifeboat run by KFC, I wouldn?t have to kill and eat Dick Cheney.)

Barnivore and other similar websites have a few shortcomings, however.? For one thing, these sites tend to focus on whether the wine (or beer or spirit) is vegan, not on whether it is good.? As a result, one needs to cross-index with some sort of quality rating.? If you?re ordering online, that?s easy enough, and a well-stocked store will typically have a wide enough selection that you can find a good wine that?s also vegan.? But if you?re at a restaurant, you may find yourself out of luck.

Part of the problem is that the listings aren?t fully comprehensive.? For example, Barnivore has no listing for Konstantin Frank, one of the better local wineries.? Understandably but sometimes frustratingly, Barnivore tends to list the largest commercial enterprises and those that specifically reached out to Barnivore.? Again, if one is buying for home, that?s not a problem.? But it does mean that one is sometimes left guessing at restaurants.

Finally, even when Barnivore has a listing, it is not always fully informative.? For instance, Barnivore lists Johnnie Walker Scotch whiskey as ?vegan friendly? based on the following email it received from the company: ?In regards to your inquiry, please do note that Johnnie Walker does not?contain any animal by-products.?? That?s good to know but not quite enough.? One can imagine that each bottle of Johnnie Walker whiskey passes through a filter specially made for that one bottle from a chimpanzee brain.? If the brain left no residue in the whiskey, then it would contain no ?animal by-products? but would be totally unacceptable to an ethical vegan (and, I imagine, totally unacceptable to most everyone else as well).? Now it happens that I know a little bit about the making of whiskey and so I have reason to think that it?s extremely unlikely that Johnnie Walker uses animal products at all (much less chimp brains).? But the information provided on Barnivore is not quite sufficient to support that conclusion.

Where does this all leave me?? Despite occasional frustrations at restaurants, I have no problem purchasing a more-than-adequate supply of high-quality vegan wine, beer and spirits.? In other words, if I have a drinking problem, the problem is not that I?m not drinking enough!

Jobless claims rise. More than 5 million on unemployment rolls.

Seasonally adjusted ?initial? unemployment claims increased by 16,000 to 357,000 claims from 341,000 claims for the prior week while seasonally adjusted ?continued? claims declined by 27,000 claims to 3.050 million resulting in an ?insured? unemployment rate of 2.4%.?

Since the middle of 2008 though, two federal government sponsored ?extended? unemployment benefit programs (the ?extended benefits? and ?EUC 2008? from recent legislation) have been picking up claimants that have fallen off of the traditional unemployment benefits rolls.?

Currently there are some 1.90 million people receiving federal ?extended? unemployment benefits.?

Taken together with the latest 3.46 million people that are currently counted as receiving traditional continued unemployment benefits, there are 5.36 million people on state and federal unemployment rolls.?

How diabetes drug delays aging in worms

Mar. 28, 2013 ? A widely prescribed type 2 diabetes drug slows down the aging process by mimicking the effects of dieting, according to a study published today using worms to investigate how the drug works.

Following a calorie-restricted diet has been shown to improve health in later life and extend lifespan in a number of animals, ranging from the simple worm to rhesus monkeys. The type 2 diabetes drug metformin has been found to have similar effects in animals but until now it was not clear exactly how the drug delays the aging process.

Researchers supported by the Wellcome Trust and Medical Research Council looked at the effects of metformin on C. elegans worms that were grown in the presence of E. coli bacteria, a relationship similar to that which humans have with the 'healthy' bacteria in our gut. They found that the worms treated with metformin lived longer only when the E. coli strain they were cultured with was sensitive to the drug.

Dr Filipe Cabreiro from the Institute of Healthy aging at UCL, who led the research, explains: "Overall, treatment with metformin adds up to 6 days of life for the worm which is equivalent to around a third of its normal lifespan. It seems to work by altering metabolism in the bacteria that live in the worm, which in turn limits the nutrients that are available to the worm host and has a similar effect to restricting the diet."

Bacteria living in the gut have an important role in helping the host organism to digest and extract nutrition from food. Defects in gut bacteria have been linked to metabolic diseases such as obesity, diabetes, inflammatory bowel disease and cancer. It has also been suggested that gut bacteria may have an impact on the aging process, but this is the first study to suggest a mechanism for how this works.

The team used strains of E. coli with defects in genes that are linked to metabolism and tweaked the levels of nutrients available to tease out which metabolic pathways might be affected by the drug. They found that treatment with metformin disrupted the bacteria's ability to metabolise folate, a type of B-vitamin, and methionine, one of the building blocks of proteins. This limits the nutrients that are available to the worm and mimics the effects of dietary restriction to enable the worms to live longer.

However, when they added an excess of sugar to the diet, the team found that the life-extending effects of metformin were cancelled out. As the drug is used as a treatment for diabetes caused by elevated glucose levels in the blood, this finding is particular relevant for understanding how the drug works in people.

Professor David Gems, who directed the study, said: "We don't know from this study whether metformin has any effect on human aging. The more interesting finding is the suggestion that drugs that alter bacteria in the gut could give us a new way of treating or preventing metabolic diseases like obesity and diabetes."

Metformin is currently one of the most widely prescribed drugs and the findings should help to inform how it is used in patients.

Top Tips for Camping | Travel and Leisure

When packing on your camping trip, make sure to pack either a set of sandals or water shoes. These will be handy in and around the campground. Monitor the elements. Rain or any other conditions may impact your travel time and your experience at the campsite. Make certain you have gear that is certainly suitable for the next thunderstorm conditions that you can face. Adjust your departure time as necessary to try to avoid the majority of the bad weather, if at all possible.

Speed of light may not be fixed after all, but rather fluctuates: Ephemeral vacuum particles induce speed-of-light fluctuations

Mar. 25, 2013 ? Two forthcoming European Physical Journal D papers challenge established wisdom about the nature of vacuum. In one paper, Marcel Urban from the University of Paris-Sud, located in Orsay, France and his colleagues identified a quantum level mechanism for interpreting vacuum as being filled with pairs of virtual particles with fluctuating energy values. As a result, the inherent characteristics of vacuum, like the speed of light, may not be a constant after all, but fluctuate.

Meanwhile, in another study, Gerd Leuchs and Luis L. S?nchez-Soto, from the Max Planck Institute for the Physics of Light in Erlangen, Germany, suggest that physical constants, such as the speed of light and the so-called impedance of free space, are indications of the total number of elementary particles in nature.

Vacuum is one of the most intriguing concepts in physics. When observed at the quantum level, vacuum is not empty. It is filled with continuously appearing and disappearing particle pairs such as electron-positron or quark-antiquark pairs. These ephemeral particles are real particles, but their lifetimes are extremely short. In their study, Urban and colleagues established, for the first time, a detailed quantum mechanism that would explain the magnetisation and polarisation of the vacuum, referred to as vacuum permeability and permittivity, and the finite speed of light. This finding is relevant because it suggests the existence of a limited number of ephemeral particles per unit volume in a vacuum.

As a result, there is a theoretical possibility that the speed of light is not fixed, as conventional physics has assumed. But it could fluctuate at a level independent of the energy of each light quantum, or photon, and greater than fluctuations induced by quantum level gravity. The speed of light would be dependent on variations in the vacuum properties of space or time. The fluctuations of the photon propagation time are estimated to be on the order of 50 attoseconds per square meter of crossed vacuum, which might be testable with the help of new ultra-fast lasers.Leuchs and Sanchez-Soto, on the other hand, modelled virtual charged particle pairs as electric dipoles responsible for the polarisation of the vacuum.

They found that a specific property of vacuum called the impedance, which is crucial to determining the speed of light, depends only on the sum of the square of the electric charges of particles but not on their masses. If their idea is correct, the value of the speed of light combined with the value of vacuum impedance gives an indication of the total number of charged elementary particles existing in nature. Experimental results support this hypothesis.

Seems like it helps prevent the give.

Judge sides with Wyoming in fracking chemical suit

(AP) ? A judge in Casper has sided with the state of Wyoming and ruled against environmentalists who sought to obtain lists of the ingredients that go into hydraulic fracturing fluids.

Environmental groups had requested the ingredient lists from the Wyoming Oil and Gas Conservation Commission, arguing that the public needs to know what chemicals companies are putting underground.

They were denied on the grounds that the lists are trade secrets that may be withheld under Wyoming's open records law. Natrona County District Judge Catherine Wilking has upheld the denial, ruling that the state official who withheld the information acted reasonably.

The oil and gas commission oversees oil and gas drilling in Wyoming. The commission chairman, Gov. Matt Mead, praised the ruling.

"This decision recognizes the importance of a state-based approach to regulating hydraulic fracturing ? one that balances this important method for producing energy with environmental protection," he said Monday through spokesman Renny MacKay.

The lawsuit was filed against the commission by the Powder River Basin Resource Council, Wyoming Outdoor Council, Earthworks and OMB Watch. Oilfield services company Halliburton intervened on the state's side.

"We continue to believe we have strong claims, and we're still concerned the Wyoming oil and gas commission is withholding this information from the public," said Shannon Anderson, an attorney for the resource council.

An appeal was an option, she said.

Specially formulated lubricants are used in fracking, which involves pumping water, fine sand and fracking fluids underground to split open oil- and gas-bearing rocks. One purpose of fracking fluids is to help the sand flow into newly formed fissures and keep them propped open.

In 2010, Wyoming became one of the first states to require companies to disclose to state regulators the ingredients in hydraulic fracturing chemicals. The goal was to help the regulators track the source of any groundwater contamination that might occur at or near a drilling site.

Environmentalists say public knowledge of the chemicals can help landowners near oil and gas projects know what types of pollution to test for in their groundwater. Such testing targeted at certain chemicals can be done before or while drilling occurs and help to establish that well water ? at least at that point ? is not polluted by those chemicals.

The specific formulations of certain fracking fluids are closely guarded corporate secrets, attorneys for Wyoming and oilfield services company Halliburton countered in arguments before Wilking in January.

Disclosure could allow competing companies to reverse-engineer fracking fluid formulas, they argued, and Wyoming's open-records law contains an exemption that allows trade secrets to be withheld from the public.

Wilking wrote that both positions have "substantial" merit.

"However the court feels these competing concerns are best addressed through legislative action, or further rule promulgation and are not properly within the court's purview," Wilking wrote.

She ruled that the state oil and gas supervisor in charge of the commission as a state agency acted reasonably in evaluating requests for trade secret exemptions under the fracking disclosure rule. The environmental groups failed to demonstrate that the supervisor didn't properly follow the rule or state law, she wrote.

Need Health Insurance? This is How You Get It Under Obamacare

It?s hard to believe that the Affordable Care Act (aka Obamacare) just celebrated its third anniversary, and yet many of the big changes that will affect the most Americans?and impact us most profoundly?won?t kick in until October 1, 2013, with more coming on January 1, 2014.?

Which doesn't mean that we're thinking about health insurance just yet, or know what to expect: A Kaiser Family Foundation poll conducted in early March 2013 found that 48 percent of those polled said they hadn't heard anything from their state about state-run health insurance exchange, and most Americans said they don't understand how the law will affect them.

But the changes, whether you like it or not, are coming: In October, state insurance exchanges will open in every state, ready to sign up individuals and many small businesses for health insurance that takes effect at the start of next year. The law requires that states make enrollment possible online, by mail, in person, or by phone.

And how will Americans enroll? It starts with a form, a draft of which was quietly released by the Department of Health & Human Services (HHS) a few weeks ago. (You can find it at the CMS.gov site, which runs Medicare and Medicaid, under the form CMS-10440.)?

The length of the mail-in ?Application for Health Insurance??21 pages?and some hard-to-follow language have sent many consumers and health advocates into a tailspin. It is worth emphasizing that this version is still very much a draft, and also that the online version of the form is still in development (no draft of that version has been released yet); that is the same version that will be used by people who apply in person or by phone.

Mara Youdelman, managing attorney for the Washington, D.C. office of the National Health Law Program, which advocates for the health rights of minorities and the underserved, says the written application is both complicated and long, because it can be used for up to six people in a household, some of whom may be eligible for different types of coverage such as Medicaid or the Children?s Health Insurance Plan. With the online system, answers will trigger prompts that skip some of the questions, but that?s not possible to do with the written form, says Youdelman.

Sarah Bagge, a health policy analyst for health reform advocacy group FamiliesUSA, also based in Washington, D.C., says that HHS, which will supervise the Affordable Care Act, estimates that each applicant will see less than one-third of all possible questions on the form if they apply online.

FamiliesUSA and the National Health Law Program are among many groups that have submitted recommendations to improve and streamline the written form. ?We don't know yet what changes HHS will make,? says Bagge. ?They received over 100 sets of comments and are continuing to do consumer testing. Changes will be based on feedback from both of those sources.? Bagge says FamiliesUSA thinks most applicants will use the online application; she bases this educated guess on information from Oklahoma, the only state with an online Medicaid application. According to a recent article in the journal Health Affairs, the state receives 94 percent of its applications online. ?

Bagge says HHS has not yet released a draft version of the online application form because the agency is still developing the electronic connections that will be needed to sync the information applicants put in and the prompts to send them to the next question or section. For example, when an applicant types in their income, the system searches to see whether they?re eligible for a subsidy. ?HHS has?done a great job overall of making a complicated eligibility process simple for consumers,? she notes.

Key issues on which FamiliesUSA made comments include suggesting simpler language on a form for employers to help them determine if their employees are eligible for subsidies; using the application to identify more disabled Americans that are eligible for special Medicaid benefits; and offering in-person help with the form for people with limited English proficiency.

Youdelman says advocacy groups know that the process of getting the application form to be comprehensive and simple to use is far from easy. ?It really is threading the needle, between making it easy to apply and asking enough questions to get individuals into the right program,? she says, adding that younger people who are comfortable online should be able to get through the process fairly quickly.

While some complexity will remain, every state will offer help for applicants. Expect to see announcements from your state health department by July 1, or even sooner.? Keep in mind, though, that a few states, including California, Washington, and Maryland are creating their own forms, which could differ from the national one ultimately released by HHS. Those states would like to use the health insurance form for other state programs such as food stamps and think it will be easier for people to sign up for state benefits if they only have one form to file. HHS, however, must approve the forms the states use, says Mara Youdelman.

Knox awaits verdict from Italy's highest court

(AP) ? Amanda Knox was waiting anxiously Monday to hear whether her ordeal is over or whether she will face trial again, as Italy's top criminal court considered whether to overturn her acquittal in the murder of her roommate.

"She's carefully paying attention to what will come out," attorney Luciano Ghirga said as he arrived at Italy's Court of Cassation. "This is a fundamental stage. The trial is very complex."

Prosecutors are asking the high court to throw out the acquittals of American Knox and her Italian ex-boyfriend in the murder of 21-year-old British student Meredith Kercher, and order a new trial.

Knox, now 25, and Raffaele Sollecito, who turns 29 on Tuesday, were arrested in 2007, shortly after Kercher's body was found in a pool of blood in her bedroom in the rented apartment she shared with Knox and others in the university town of Perugia, where they were exchange students. Her throat had been slashed.

Knox and Sollecito were initially convicted and given long prison sentences: 26 years for Knox, 25 for Sollecito. But in 2011 the appeals court acquitted them, criticizing virtually the entire case mounted by prosecutors in the first trial. The appellate court noted that the murder weapon was never found, said that DNA tests were faulty and added that Knox and Sollecito had no motive to kill Kercher.

After nearly four years behind bars, Knox returned to her hometown of Seattle and Sollecito resumed his computer science studies.

In the second and final level of appeal, prosecutors are now seeking to overturn the acquittals, while defense attorneys say they should stand.

The court can decide to confirm the acquittal, making it final, or throw out the Perugia appellate court ruling entirely or partially, remanding the case to a new appeals court trial.

In that case, Italian law cannot compel Knox to return to Italy, although a court could declare her in contempt of court, which carries no additional penalties.

Prosecutor general Luigi Riello argued before the court that there were ample reasons "not to bring down the curtain on the case."

Riello said the appellate court was too dismissive in casting aside DNA evidence that led to the conviction in the lower court, arguing that another trial could make way for more definitive testing.

Neither Knox nor Sollecito was in court for the hearing, which opened with a summary of the gruesome murder, although Sollecito's father attended.

Defense attorneys said they were confident the acquittals would be upheld. "We know Raffaele Sollecito is innocent," said Sollecito's attorney, Giulia Bongiorno, who called the entire case "an absurd judicial process."

A verdict could come later Monday.

Knox and Sollecito have both maintained their innocence, though they said that smoking marijuana the night Kercher was killed had clouded their recollections.

Prosecutors have alleged that Kercher was the victim of a drug-fueled sexual assault.

A young drifter from Ivory Coast, Rudy Guede, was convicted of the slaying in separate proceedings and is serving a 16-year sentence. Kercher's family has resisted theories that Guede acted alone.

The lawyer for the Kercher family, Francesco Maresca, was in court Monday.

The court is also hearing Knox's appeal against a slander conviction for having accused a local pub owner of carrying out the killing. The man was held for two weeks based on her allegations, but was then released for lack of evidence.

Riello argued that conviction should stand because "you cannot drag in an innocent person while exercising your right to a defense."

Palestinians cool to partial settlement freeze

RAMALLAH, West Bank (AP) ? A senior Palestinian official rejected on Sunday the idea of a partial Israeli settlement freeze as a way of restarting peace talks, a sign of tough times ahead for the Obama administration's new attempt to bring the sides together.

U.S. Secretary of State John Kerry met separately late Saturday with Palestinian President Mahmoud Abbas and Israeli Prime Minister Benjamin Netanyahu to talk about ending a deadlock of more than four years over settlements.

Abbas says he won't return to negotiations without an Israeli construction freeze, saying Israel's building on war-won land pre-empts the outcome of talks on a border between Israel and a future state of Palestine. Abbas last held talks with Netanyahu's predecessor in late 2008.

Netanyahu has refused to halt construction and instead calls for an immediate return to negotiations. President Barack Obama sided with Israel's position during a visit to the region last week, saying the Palestinians should return to talks to sort out the settlement issue.

The U.S. has not spoken publicly about possible compromises in recent days, though there has been some speculation it would propose a partial construction stop in the West Bank heartland, east of Israel's separation barrier.

Palestinian negotiator Saeb Erekat said Sunday that the Palestinians do not seek a confrontation with the Obama administration, but appeared to suggest that nothing short of a full freeze will bring them back to negotiations.

The Palestinians want a state in the West Bank, Gaza and east Jerusalem, areas Israel captured in 1967. Since that war, Israel has built dozens of settlements ? considered illegal by much of the world and now home to more than half a million Israelis ? in the West Bank and east Jerusalem.

Much of the construction takes place in so-called "settlement blocs" close to Israel and in east Jerusalem. Israel's separation barrier cuts off east Jerusalem and some of the settlement blocs from the rest of the West Bank.

Asked if Abbas would accept a partial freeze, east of the barrier, Erekat told Voice of Palestine radio: "Absolutely not. It is rejected."

"First of all, 90 percent of the building in settlements is going on in the blocs," he said. "If we accepted that, we would be committing two crimes. The first is legalizing what is illegal, which is settlement construction, and the second is accepting the Israeli policy (of) dictation."

Israel agreed to a 10-month slowdown in settlement construction early in Obama's first term, allowing talks to resume briefly in 2010. The talks fizzled out after Netanyahu refused to extend the slowdown, which had halted approvals for new homes but allowed previously started construction to continue.

Israeli Justice Minister Tzipi Livni, who will oversee any negotiations with the Palestinians, said it remained to be seen what would bring about a new round of talks.

"We are after four years of stalemate, of distrust, and we need to see how we restart, what we will discuss," she told Army Radio.

Erekat said the Palestinians would wait for two to three months to see if the Obama administration can come up with a way out of the deadlock. "We want to cooperate with the U.S. administration, not clash with it," he said.

If the deadlock persists, the Palestinians will move ahead with their quest for international recognition, he said. "We have to focus on the steadfastness of our people, and we have 63 international agencies we can join," he said.

In November, the U.N. General Assembly overwhelmingly recognized a state of Palestine in the West Bank, Gaza and east Jerusalem, despite objections by the U.S. and Israel. The recognition paved the way for Palestinians to seek membership in U.N. agencies and other international organizations.

Earlier Sunday, Israel dismantled a tent camp Palestinians set up during Obama's recent visit to protest Israeli plans to build a large West Bank settlement near Jerusalem.

During his visit, Obama singled out the settlement, known by its planning name E-1, as particularly problematic. The settlement of more 3,500 apartments would close one of the last open spaces between east Jerusalem and the West Bank.

Before dawn Sunday, about 200 Israeli police officers removed some 40 demonstrators from the tent camp, said police spokesman Micky Rosenfeld. Three protesters were arrested, but no injuries were reported, Rosenfeld said.

The encampment is part of a new Palestinian tactic to protest against Israeli settlement expansion.
